By submitting items for consignment at Shimmer Boutique, the Consignor agrees to the following Terms and Conditions. Please read this document carefully before signing. This agreement governs the relationship between Shimmer Boutique (the "Store") and the individual submitting items for sale (the "Consignor").
The consignment period is sixty (60) days from the date items are accepted by the Store. During this period, the Store will actively offer the Consignor's items for sale. The consignment period begins on the intake date recorded on the Consignor's account.
Shimmer Boutique reserves the right to accept or decline any items at its sole discretion. To be considered for consignment, all items must meet the following requirements:
If any damage, staining, or condition issues are discovered after an item has been admitted for consignment, the affected item will be automatically removed from the sales floor and donated to a charitable organization without further notice to the Consignor.
Upon submitting items for consignment, each Consignor is provided access to a personal online account through the Shimmer Boutique online portal. The online account allows Consignors to:
It is the Consignor's responsibility to maintain accurate contact and payment information within their account. Shimmer Boutique is not liable for missed notifications, delayed payouts, or other issues resulting from outdated account information. Account credentials are personal and should not be shared.
The Store reserves the right to set, adjust, and discount all pricing on consigned items. The Store may, at its discretion, reduce prices on items that have not sold within a reasonable period during the consignment term. The Consignor agrees to these pricing decisions without requiring additional consent.
Upon the sale of a consigned item, the Consignor will receive a payout based on the following commission structure:

The Store retains the remaining percentage of each sale as its commission for operating costs, marketing, and services rendered.
Consignors may choose from the following payout methods. Processing fees are deducted from the payout amount:
*All applicable fees are deducted from the Consignor's payout prior to disbursement.
There is no set payout schedule; Consignors may request their payout at any time through their preferred method.
We request to pick up your funds within one year from the drop-off date. Unclaimed payout balances that remain inactive for three (3) years from the date of last account activity will be deemed abandoned and reported and remitted to the State of California in accordance with California's Unclaimed Property Law. Prior to escheating any funds, the Store will make a reasonable attempt to notify the Consignor at their last known contact information on file.
The Consignor may retrieve their unsold items at any time prior to the end of the 60-day consignment period. There is no early termination fee. To retrieve items early, the Consignor must contact the store by phone during business hours, Tuesday through Friday, to submit a retrieval request. Please allow a minimum of 24 hours from the time of the request before coming in for pickup.
At the conclusion of the 60-day consignment period, the Consignor has seven (7) days to retrieve any unsold items from the Store. It is the Consignor's responsibility to track their consignment end date and arrange pickup within this window.
If unsold items are not retrieved within 7 days of the consignment period ending, the following will apply:
Shimmer Boutique takes reasonable precautions to protect consigned items; however, the Store is not responsible for loss, theft, damage, or destruction of consigned items while in the Store's possession.
By agreeing to these Terms and Conditions, the Consignor assumes all risk associated with their items and acknowledges that the Store will not provide compensation for items that are lost, stolen, damaged, or otherwise rendered unsellable due to circumstances beyond the Store's control.
The Consignor warrants that they are the rightful owner of all items submitted for consignment and that such items are free from any liens, claims, or encumbrances. The Consignor retains ownership of unsold items until they are either sold, donated, or discarded in accordance with these Terms. Title to sold items passes directly from the Consignor to the buyer at the point of sale.
Shimmer Boutique reserves the right to update or modify these Terms and Conditions at any time. Consignors will be notified of material changes. Continued use of consignment services following notification constitutes acceptance of the updated terms.
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Marin County, California.
By making a consignment appointment the Consignor acknowledges that they have read, understood, and agreed to the Consignment Terms and Conditions set forth by Shimmer Boutique.
